Terms and Conditions

§ 1. General provisions

1. The GeekFolk online store, operating at www.geekfolk.pl, is run by BIN-EK DAWID BIEŃKOWSKI, registered at Marianka 2, 99-413 Chąśno, Poland, Tax ID (NIP) 8341845748, REGON 361637924, hereinafter referred to as the Seller.

3. These Terms and Conditions set out the rules for concluding sales contracts via the Store and the rights and obligations of the parties.

§ 2. Definitions

Customer — a natural person, legal person or organisational unit making a purchase in the Store.
Consumer — a Customer who is a natural person performing a legal transaction not directly related to their business or professional activity.
Sole trader with consumer rights — a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for them.
Goods — a product presented in the Store.
Goods on order — Goods marked in the Store as “On order”, which the Seller does not have in stock at the given moment and which it obtains from the distributor after the order is placed.

§ 3. Placing orders

1. Orders can be placed 24 hours a day, 7 days a week.

2. An order is placed by adding Goods to the cart, completing the order form and confirming with the button labelled “Zamawiam i płacę” (Order and pay).

3. The sales contract is concluded when the Customer receives an email confirming that the order has been accepted for fulfilment.

4. The Customer may create an account in the Store or make a purchase without registering.

§ 4. Prices and payments

1. All prices shown in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN).

2. The price of the Goods does not include delivery costs, which are shown in the cart before the order is placed.

3. Available payment methods include, in particular, BLIK, payment card (Visa, Mastercard, Maestro) and the Shop Pay, Apple Pay and Google Pay wallets. The full, up-to-date list of payment methods is presented to the Customer in the order summary before the order is placed. Payments are handled by Shopify Payments. The Seller does not offer cash on delivery.

4. Where the price of Goods is reduced, the Seller shows, next to the promotional price, the lowest price of those Goods in the 30 days before the reduction, in accordance with the Omnibus Directive.

5. Promotional discounts are applied automatically in the cart and in the order summary; no code is required.

6. Failure to pay within 3 business days of placing the order entitles the Seller to cancel it.

§ 5. Delivery and fulfilment times

1. Orders are fulfilled within the territory of the Republic of Poland.

2. Orders paid for on a business day are dispatched on the next business day.

3. Goods marked in the Store as “On order” are dispatched by the Seller within 5 business days of the payment being received. Information that the Goods are Goods on order, and their dispatch time, is shown on the product page before the order is placed. If, for reasons beyond the Seller's control, obtaining the Goods proves impossible, the Seller informs the Customer without delay and refunds the full amount paid, no later than within 14 days.

4. If an order includes both Goods available immediately and Goods on order, the whole order is dispatched within the time applicable to the Goods on order, unless the Customer asks for the shipment to be split.

5. Delivery is carried out by InPost, DHL or DPD — the choice is the Customer's. For delivery to a parcel locker (Paczkomat), the Customer selects the pickup point in the cart.

6. Delivery costs and the free delivery threshold are shown on the “Delivery and payment” page.

§ 6. Right of withdrawal

1. A Consumer and a sole trader with consumer rights may withdraw from the contract without giving a reason within 14 days of the day they took possession of the Goods.

2. The statement of withdrawal should be sent to Reklamacje.geekfolk@outlook.com or in writing to: Marianka 2, 99-413 Chąśno.

3. The Goods must be sent back without undue delay, no later than 14 days from the date of withdrawal. The direct cost of the return is borne by the Customer.

4. The Seller refunds all payments, including delivery costs up to the amount of the cheapest delivery method offered, within 14 days of receiving the statement, using the same payment method, unless the Customer indicates otherwise.

5. The right of withdrawal does not apply, among others, to Goods supplied in sealed packaging which cannot be returned once opened for health protection or hygiene reasons.

§ 7. Complaints

1. The Seller is liable for any lack of conformity of the Goods with the contract under the rules set out in the Consumer Rights Act (ustawa o prawach konsumenta).

2. Complaints should be submitted to Reklamacje.geekfolk@outlook.com, stating the order number, a description of the non-conformity and — where possible — photographic evidence.

3. The Seller processes the complaint within 14 days of receiving it.

§ 8. Personal data

The rules for processing personal data are described in the Privacy Policy.

§ 9. Out-of-court dispute resolution

The Consumer may use out-of-court complaint handling and redress procedures, including the ODR platform available at ec.europa.eu/consumers/odr.

§ 10. Final provisions

1. Matters not covered by these Terms and Conditions are governed by Polish law.

2. The Seller reserves the right to amend these Terms and Conditions. Orders placed before an amendment are governed by the Terms and Conditions in force on the day the order was placed.

3. These Terms and Conditions are effective from 26 August 2026, as amended on 18 September 2026.
